RestoPhoto Terms of Service

§1. General provisions and definitions

The Service is intended solely for businesses and professional users (B2B). By registering, the User confirms use in connection with their trade, business, craft, or profession.

• Service - the RestoPhoto online platform at restophoto.app and related applications.
• User - a natural person acting in a business capacity, legal person, or organizational unit using the Service.
• Account - the User’s individual profile protected by login credentials.
• Subscription - a paid plan granting access to Service features on a monthly cycle.
• AI Content - images, videos, and other materials generated with AI within the Service.
• Operator - FastTip Sp. z o.o., os. 2 Pułku Lotniczego 13 lok. 2, 31-868 Kraków, Poland, NIP: 6751808533, KRS: 0001148920. Registry court: District Court for Kraków-Śródmieście in Kraków, 11th Commercial Division of the KRS; share capital: PLN 5,000.00.

§2. Scope of the service

The Service enables AI-assisted creation of professional food photos and short videos for hospitality businesses (restaurants, cafés, food trucks, hotels), including image enhancement, video reels, social copy, and crops for delivery platforms.

§3. Registration and account

1. Registration is via Google sign-in (OAuth 2.0) or the registration form.
2. The User must provide accurate information and must not share login credentials with third parties.
3. The Operator may suspend or delete the Account in case of a material breach of these Terms.

§4. Subscription and payments

1. Paid features require an active Subscription.
2. Payments on the web service are processed by Stripe, Inc.; the User accepts the payment provider’s terms.
3. Purchases made in the mobile apps are processed as in-app purchases via the App Store (Apple) or Google Play (Google). Such purchases, including refunds and cancellations, are governed by the rules and procedures of the respective store.
4. The Subscription renews monthly unless cancelled before the end of the current billing period.
5. Due to the B2B nature of the Service, no refunds apply for a started or paid billing period. Unused monthly generations do not roll over.

§5. AI-generated content and liability

1. The Operator provides advanced technology; given the nature of AI, it does not guarantee a specific style or fully predictable outputs.
2. The User must have appropriate rights to source materials (e.g. logos, photos) they upload.
3. The User decides how and where to publish generated content and is responsible for that use.

§6. Copyright and licences

1. The User retains rights to uploaded source materials. By uploading, the User grants the Operator a technical licence to process them solely to generate AI Content on the User’s request.
2. AI Content is machine-generated; the Operator claims no copyright. The User may use it commercially for their business.

§7. Prohibited use

The User must not use the Service to:

• Generate unlawful, abusive, pornographic, or hate-inciting content.
• Abuse the Service API, including automated mass generation beyond plan limits.
• Attempt to circumvent technical protections.
• Resell access to the Service without the Operator’s consent.

§8. Limitation of liability and complaints

1. The Service is provided “as is”.
2. Total liability of the Operator is limited to fees paid by the User in the last 3 months. This limitation does not apply to damage caused by the Operator intentionally.
3. Complaints: [email protected]. The Operator will respond within 14 days.

§9. Final provisions

1. These Terms are governed by Polish law.
2. Disputes fall under the courts having jurisdiction over the Operator’s seat.
3. The Operator may amend these Terms with reasonable prior notice to Users.
